Real Estate Law Update: New law


This law will be going to effect on October 1, 2010.

Rental Housing - Protection for Victims of Domestic Violence and Sexual Assault

Under this new law, a victim of domestic violence or sexual assault who has received a protective or peace order from the court may terminate a lease upon 30 days notice to the landlord. The law also would require landlords to change the locks within 24 hours upon request of a victim or if not changed would allow tenants with protective or peace orders to change the lock using a certified locksmith. The tenant would have to provide the landlord with a copy of the key by the close of the next business day after the lock change. The tenant is responsible for paying the reasonable cost of changing locks, which the landlord may charge as additional rent or withhold from the security deposit if not paid within 45-days.
